1. Introduction
These Terms and Conditions constitute a legally binding agreement between Caspersmm Cloud (the “Provider”) and you (the “Client”). By accessing our website, purchasing our services, or interacting with our brand, you acknowledge that you have read, understood, and agreed to be bound by every clause listed below.
2. Strict Non-Refundable Policy
- Digital Goods & Services: Due to the bespoke and digital nature of our creative services, all sales are final and non-refundable.
- Immediate Allocation: Once an order is placed, our team immediately allocates time and resources; therefore, no cancellations or “change of mind” requests will be accepted.
- Chargeback Waiver: By completing a purchase, the Client explicitly waives the right to initiate any chargebacks or payment disputes with their bank or payment processor.
3. Information Accuracy & Client Responsibility
- Submission of Details: The Client must provide accurate and complete information (Store Name, Style, Colors, and Specific Details) in the “Order Notes” or via official email.
- Client Errors: CasperSMM Cloud is not liable for errors provided by the Client (e.g., typos in the store name or incorrect color choices). Any corrections required due to Client error after work has commenced will be subject to the Revision Fee.
4. Project Production Timeline
- Standard Window: The design process typically takes between 4 business days to 2 weeks.
- Estimates Only: While we aim for prompt delivery, these timelines are estimates and can be affected by the complexity of requirements, seasonal demand, or delays in Client communication.
- Queue Management: Projects are processed in the order they are received.
5. Detailed Revision & Modification Policy
- Initial Concept Confirmation: After the first draft is presented, the Client must confirm the direction.
- Revision Charges: Any modification requested after the initial confirmation is strictly charged at $1 USD per change.
- Scope Definition: A “revision” refers to minor adjustments (e.g., font size, color shade, slight alignment). Requesting a completely new design concept or a change in the core idea constitutes a new project and requires a new purchase.
6. Final Delivery & 24-Hour “Auto-Complete” Rule
- Inspection Window: Upon delivery of the final files to the Client’s email, a 24-hour review window begins.
- Reporting Adjustments: All final artistic adjustment requests must be sent to artistic.uv@gmail.com within this 24-hour period.
- Automatic Finalization: If no response is received within 24 hours, the project is legally marked as “Automatically Completed”. CasperSMM Cloud is then released from any further obligations, and any later requests will be billed as new services.
7. Intellectual Property & Usage Rights
- Client Rights: Upon full payment and final delivery, the Client is granted the right to use the designs for their personal or business branding.
- Portfolio Rights: Caspersmm Cloud retains the perpetual right to display any created work (including drafts) in our portfolio, website, or social media for marketing and promotional purposes.
8. Limitation of Liability & Indemnification
- No Warranty: We provide designs “as is” without any express or implied warranty.
- Business Loss: Caspersmm Cloud shall not be held liable for any loss of profit, loss of business, or incidental damages resulting from the use of our designs or any delays in delivery.
- Legal Indemnity: The Client agrees to indemnify and hold Caspersmm Cloud harmless from any legal actions resulting from the Client’s use of the designs (e.g., trademark or copyright issues related to the Client’s business name).
9. Professional Conduct & Termination
We reserve the right to terminate any service or refuse future business with any Client who displays unprofessional behavior, harassment, or fails to comply with these terms. In such instances, no refund will be issued.
10. Amendments
Caspersmm Cloud reserves the right to update these Terms and Conditions at any time without prior notice. The version live at the time of purchase shall apply.
